MONTEL shares this text to explain the reasons for processing personal data, the methods of collection, legal basis, and the legal rights of data subjects in accordance with the Law on the Protection of Personal Data No. 6698 (KVKK), as a result of the high importance it attaches to the privacy and security of its customers, employees, job applicants, and all business partners.
MONTEL, may collect personal data directly or indirectly through one or more of the following methods: all communications and correspondences through communication channels; messages and applications received through the website and social media accounts; use of mobile applications; internet cookies; data sharing during participation in internet networks; physical and electronic records kept at workplaces; printed or electronic contracts, forms, and surveys; data transferred by business partners.
- Confirming the shopper´s identity information; To be able to provide necessary information in order to fulfill all contractual obligations, especially the sales contract and the contracts concluded as per the Law on the Protection of the Consumer; to carry out acts;
- To be able to provide information to public institutions, especially judicial organs and law enforcement forces, on matters related to public security, upon the request of the relevant authority;
- To be able to use it in all kinds of marketing activities with the special and general campaigns (promotions, promotions, discounts, etc.) organized by MONTEL;
- Getting to know the customers shopping from MONTEL closely and developing marketing activities in this direction;
- To be able to use it in various marketing and advertising activities and within this scope, to be able to conduct marketing activities, surveys and market analyzes in electronic and/or physical environment through contracted institutions;
- Evaluating and reporting customer complaints and suggestions and sharing data with contracted business partners within the scope of marketing activities;
- To fulfill legal obligations and to use the rights arising from the current legislation;
- To be able to transfer data to third parties (contracted business partners) for the fulfillment of legal obligations;
- To improve products and services;
- To be able to store it in the database for the purpose of fulfilling the obligations arising from commercial contracts and reminding them when necessary;
- To better meet MONTEL customers´ shopping needs;
- To provide customer specific offers and services;
- Creating a database, making listing, reporting, verification, analysis and evaluations, Producing statistical information and sharing them with third parties who are experts in their business, provided that they comply with the confidentiality conditions when necessary,
- To analyze how the MONTEL website, mobile applications and other communication and sales channels are used and to make communication channels specific to the visitor for better service,
- Researching and developing products and services and personal ion opportunities related to them,
- To contact the personal data owner through the communication channels shared with MONTEL, directly for the purpose of market research or through the service providers from whom service is received for this purpose,
- It may be processed for the purpose of protecting the life and property of MONTEL employees, organizations serving MONTEL or their employees or MONTEL guests, or fulfilling legal obligations or requests of authorized administrative institutions, including compliance with the rules set forth in this article.
Except for the cases listed above:
- MONTEL workplaces are monitored by security cameras in order to ensure the safety of customers and employees. The images recorded during this monitoring can be shared with the judicial institutions and law enforcement agencies, in case of legal application.
- Resumes submitted by MONTEL employee candidates to MONTEL for job applications can be kept by MONTEL Human Resources in order to evaluate possible opportunities for the benefit of the applicant. Personal files of MONTEL employees whose service relationship is still ongoing or terminated are kept in accordance with legal obligations.
- Personal data belonging to MONTEL´s business partners or business associates and their employees may be processed for the smooth administration and continuity of the operation carried out together.
MONTEL processes personal data up to date, depending on the purpose for which it was collected, in a way that varies depending on the service provided or the commercial activity carried out. Data processing activities are carried out based on the Law on the Protection of Personal Data No. 6698, the Turkish Code of Obligations No. 6098, the Law on the Protection of Consumers No. 6502, the Labor Law No. 4857, the Law No. 29166 on the Regulation of Electronic Commerce, and other legislation.
3.The Processing Period of Your Personal Data:
The personal data collected by MONTEL is processed in accordance with the legislation on the protection of personal data, especially the KVKK, and the periods required by other legislation.
4.To Whom and For What Purpose Your Processed Personal Data Are Transferred
In addition to the purposes listed in this text, MONTEL collects the personal data it collects within the scope of the KVKK and other legislation:
- Fulfilling the commercial activities of MONTEL in accordance with the legislation and company policies,
- Designing, planning and executing human resources activities,
- Meeting the requests for legal information and documents,
- It may transfer it to third parties or abroad in order to ensure the commercial and legal safety of MONTEL and its employees, business partners and customers, to ensure and protect its commercial reputation.
Perspnal data colleckted by MONTEL:
- Storage, archiving, information technology support (server, hosting, program, cloud) in the country and abroad, mainly EU countries, America, England, OECD countries, India, China and Russia IT), security, call center, to third parties that MONTEL provides assistance to, Group Companies with which it cooperates and/or receives services, business partners, supplier companies, banks, financial institutions, legal, social, commercial and other consultants, where transfer is necessary. to other persons and authorized institutions and organizations;
- Within the scope of Articles 5.1 and 6.3 of the KVKK, marketing companies, Group Companies, real estate agents providing marketing support, provided that express consent is obtained for the determined purposes in Turkey and abroad, especially EU countries, America, England, OECD countries, India, China and Russia. and transferable to legal entities.
5.Rights of Personal Data Subject
Within the scope of KVKK, personal data owner:
- Learning whether their personal data is processed,
- Requesting information on personal data if processed,
- To learn the purpose of processing personal data and whether they are used in accordance with their purpose,
- To know the third parties to whom personal data is transferred, in the country or abroad,
- Requesting correction of personal data in case of incomplete or incorrect processing,
- To request the deletion or destruction of personal data in case the reasons for the processing of personal data disappear, in order to be evaluated within the principles of purpose, duration and legitimacy,
- Requesting the notification of the third parties to whom the personal data has been transferred, in case of correction, deletion or destruction of personal data,
- Objecting to this result in case the processed personal data is analyzed exclusively through automated systems and a negative result occurs,
- She/He has the right to demand the compensation of the damage in case her personal data is processed unlawfully and in case of damage due to this reason..
The request regarding the rights listed above must be submitted to MONTEL in writing in accordance with Article 13/1 of the KVKK or by other methods determined by the Personal Data Protection Board. Applications by e-mail should be sent to info@montel.com.tr. It should not be forgotten that the information that will help to identify the personal data owner should be included in the applications.
MONTEL finalizes the personal data owner´s application free of charge as soon as possible and within thirty days at the latest, depending on the nature of the request. In so far, if the transaction requires a separate cost, the fee in the tariff determined by the Personal Data Protection Board may be charged.
MONTEL can accept the request of the personal data owner or reject it by explaining its reason. The result of the application is notified in writing or in electronic form.
